Proof NH Attorney Eric Maher Knows Nothing About RTK Laws!

Epping's legal counsel Eric Maher asks the Court for permission to withdraw its lawsuit against Right-to-Know activist Jeffrey Thomas Clay, proving Donahue, Tucker & Ciandella Attorney Eric Maher Knows Noting About NH RTK Laws!

On January 24, 2024, Attorney Maher filed a lawsuit against Mr. Clay in Rockingham Superior Court alleging Mr. Clay (a private citizen) violated RTK by requesting to inspect public records (stupid is what stupid does).

Clay filed a Motion to Dismiss Epping's lawsuit alleging Epping did not have standing to bring the suit as they had not suffered any harm; in fact, the harm they alleged is their legal duty and responsibility (to respond to RTK requests).

With the Motion to dismiss pending before the Court, Epping withdrew its frivolous, unjust, vexatious, wanton, and oppressive lawsuit to avoid accountability for its bad act of filing the suit. This tactic will not stand.

Epping's lawsuit was never authorized by Epping Selectmen (at least not legally). There are no public or non-public meetings from which the Selectmen could have authorized the lawsuit's filing. This is a big problem not only for the Selectmen but also for Attorney Maher. Only the Selectmen could authorize Maher to file a lawsuit; this did not happen.

Very shortly I will be filing a lawsuit against Epping and members of the Board of Selectmen personally. I am also in the process of filing a grievance against Attorney Maher with the NH Attorney Discipline Office.

Epping taxpayers should not have to foot the bill for fraudulent and unethical acts committed by their public officials. Epping officials, including Town Manager Jake Roger, knew their legal responsibilities under Right-to-Know. However, instead of complying with the law, they purposefully chose to violate the law and harass a private citizen to intimidate him from exercising his rights under the law.

For their bad acts, every member of the Epping Board of Selectmen and Town Manager must reimburse Epping for unnecessary wasted legal fees and then resign or be removed.
