Merrimack Man Charged With Simple Assault, Possession of Pot

The following information was provided by the Merrimack Police Department. An arrest does not indicate a conviction

David Harder, 35, of Merrimack, was charged late last week with possession of marijuana and two counts of domestic-related simple assault.

Merrimack Police say they took a report at the police station of a domestic assault that took place earlier in the night on July 5. The victim alleged being pushed twice during the incident. After a brief investigation, police determined Harder would be arrested for the domestic assault under the state of New Hampshire 12-hour domestic law, which says a person can be arrest following an incident within 12 hours of its occurrence without a warrant.

Harder was taken into custody without incident, police say, but he was found to have a small quantity of marijuana on him. He was later released on $2,500 personal recognizance bail and ordered to appear in front of the 9th Circuit District Court in Merrimack on July 10.

Also arrested recently:

Daniel Mcauliffe, 38, of 84 Kimball Road, Rindge, was charged with operating under the influence of liquor and speed after he was observed Sunday at 1:30 a.m. traveling at a high rate of speed on Route 101A in Merrimack. Police say Mcauliffe did not pull over when signaled to do so but eventually stopped in Amherst. After a brief investigation Mcauliffe was arrested for OUIL. He was placed on $1,500 personal recognizance bail and ordered to appear at Merrimack's district court on July 31 to answer the charges. He was released to Hillsborough County Jail for protective custody.

William Paige Jr., 22, of 28 Walnut Circle Merrimack, was charged with criminal mischief Friday, July 6, for causing a disturbance in Bradford Woods condominium complex shortly after 7 p.m. Police say they were called to the pool house at the Spring Road complex for a report of a domestic-related incident in progress. They arrested Paige for allegedly ripping a license plate off a vehicle he didn't own. He was released on $1,500 personal recognizance bail and ordered to appear in front of the 9th Circuit District Court in Merrimack on July 10. 

Daniel Wilson, 42, of Penacook Terrace, Merrimack, was charged with two counts of simple assault on the Fourth of July. Police say they were called to Penacook Terrace just after 8 p.m. on July 4 for a disturbance. Upon their arrival, police say learned Wilson had assaulted another member of the household, pushing them to the floor and pushing them in the face. Wilson was transported to the Merrimack Police Department. He was held on $2,500 cash bail and arraigned in the 9th Circuit District Division Court on July 5, on the misdemeanor charges. A misdemeanor is punishable by a year in jail and/or a $2,000 fine.

David Mielke, 29, of 12B Star Drive, Merrimack, was charged on Tuesday, July 3, with operating while under suspension. According to police, Mielke was stopped on Cramer Hill Road for an expired inspection sticker. Upon identifying the operator as Mielke, a license check revealed his license had been suspended out of Nashua for a driving while intoxicated conviction last Aug. 18. Mielke was released on $1,500 personal recognizance bail and scheduled to appear in the 9th Circuit Court District Division in Merrimack on July 31.
