Alleged Shoe Thief Strikes Again

Woman caught allegedly trying to steal a pair of shoes, again.

Marion Smith, 36, of 6 Cross Street, Nashua, was arrested and charged with Robbery, a Class A Felony, after allegedly stealing shoes from a local department store.

According to police, Smith has been down this road before, the last time, in December, over a pair of shoplifted sneakers.

On March 23 police were called for a report of a theft from Kohl’s, located on Gusabel Avenue in Nashua. Police were told that as the adult female suspect left the store with shoes she did not pay for, she pushed the loss prevention employee out of her way. No one was injured.

Detectives from the Criminal Investigations Division furthered the investigation and Marion Smith was identified as the suspect. Smith was located and arrested at her residence.

A Class A Felony is punishable by up to 15 years in State Prison, exclusive of fines. Ms. Smith is being held on $10,000.00 personal recognizance bail and she is scheduled to be arraigned in Nashua District Court on March 26, 2012.

Smith was arrested December 30 on a felony sneaker shoplifting charge, after taking a pair of sneakers from a local department store. Because she had two previous shoplifting convictions, she was charged with a felony under the "Three Strikes" provision of the law.

Nashua Police Lt. Michael Moushegian said that the March 23 robbery charge was made at the police department's discretion.

"We could've charged her with "third strike" but robbery has more weight to it. It's possible the county attorney could amend the charge from robbery to a third strike," Moushegian said.

Moushegian said that the December sneaker shoplifting charge is still pending.
