Man Charged With Credit Card Fraud
Police said Justin Spencer was nabbed as he left a local restaurant with food he had just charged to a stolen credit card.

Justin Spencer, 24, of Nashua, was arrested Nov. 11, charged with: Receiving Stolen Property, class A misdemeanor; and Fraudulent use of a Credit Card, class A Misdemeanor.
Although this particular crime is considered a misdemeanor, the charge rises to a felony charge, due to the fact that Spencer had at least two prior misdemeanor convictions for misdemeanor theft, said Nashua Police Lt. Michael Moushegian.
"We call it a Third Strike conviction. Although it's a misdemeanor crime, statutorially it becomes a felony due to his prior convictions," Moushegian said.

Police responded on Nov. 11 at about 11:30 a.m. to 30 Temple St. for a report of a theft from an office. Officers conducted an investigation and learned that one of the stolen credit cards was used at a local restaurant. Patrol officers responded to the restaurant and located Spencer leaving the restaurant with food allegedly purchased with the credit card. Spencer was arrested without incident.
A subsequent investigation by the Detective Bureau resulted in the Receiving Stolen Property charge being upgraded to a class B, felony due to Spencer having theft related convictions on his record.

Spencer is being held on $5,000 cash/surety bail pending his arraignment at the Nashua District Court. A class B felony is punishable by up to seven years imprisonment exclusive of fines. A class A misdemeanor is punishable by up to one year imprisonment exclusive of fines.
