NH Court Cites Man Who Threatened Transgender Nashua Gym Patron

NASHUA, NH — The New Hampshire Attorney General's office has been granted an injunction against a man determined to have threatened to kill a transgender women at a Planet Fitness in Nashua over the use of a locker room. Marc Bernier was found to have violated the New Hampshire Civil Rights Act and has been ordered to stay away from both the woman and the Planet Fitness on Northwest Boulevard for at least one year.
Attorney General Gordon MacDonald announced the decision from the Hillsborough Superior Court South on Monday relating to the incident that occurred on March 17.
The AG's office said the trial court found that Bernier repeatedly threatened to kill the woman after he had learned she used the women's locker room to change. The AG's office said Bernier's threats were based in his belief that she should not have used the locker room because of his perceptions of her gender.

The injunction states that Bernier cannot knowingly go within 250 feet of the victim or enter the Planet Fitness. The injunction lasts for one year. Bernier will have all but $500 of his $3,000 civil penalty suspended on the condition that he complies with the terms of the injunction.
The Civil Rights Unit enforces state and federal civil rights laws, including the New Hampshire Civil Rights Act and the New Hampshire Law Against Discrimination. Anyone who believes their civil rights may have been violated may file a complaint here or by calling 603-271-1181.
