Gym Reaches Agreement with NH AG
Report: The Fort Crossfit of Hampstead failed to register with consumer protection, anti-trust bureau.

Attorney General Joseph A. Foster announced today that the NH AG’s Office had entered into an Assurance of Discontinuance with The Fort Gym, LLC and Kyle Rochefort, dba The Fort Crossfit, a health club located in Hampstead, to resolve allegations that the health club failed to register with the Attorney General’s Consumer Protection and Antitrust Bureau since it club opened in April 2011, according to a report.
Under the terms of the Assurance, The Fort Gym must register annually, as required by the health club statute, N.H. RSA 358-I, and must pay a sum of $500 in lieu of a civil penalty for the past failures to register.
All owners and operators of health clubs and martial arts schools are reminded that they are required to register annually with the Attorney General. Martial Arts Schools are required to register by N.H. RSA 358-S. Registrants are required to post a security bond to protect consumer prepayments, although exemptions apply under certain limited circumstances.

Failure to register and to otherwise comply with both the health club and martial arts statutes constitutes an unfair or deceptive practice under the State’s Consumer Protection Act, N.H. RSA 358-A.
