As Howe approached the men, who were facing each other in a dispute, one of the men walked toward Howe's vehicle, holding a gun in his hand. Howe shouted for the man to stop and surrender the gun. The man complied and slid the gun on the ground toward Howe, saying he had taken it from the other man in the alley.
While Howe recovered the gun, a loaded, .40 caliber Ruger, the two men began fighting again, until Howe and some onlookers were able to separate them.

As Howe continued to investigate, the man who initially surrendered the gun to him left the area. But based on further investigation, police determined that the gun belonged to Kane, who had reportedly encountered several men inside the club whom he had known from high school.
The encounters led to at least one confrontation during which Kane reportedly removed the loaded firearm from his waistband, pointing it at the chest of a man. Another man followed Kane outside and disarmed him as police arrived on scene.
