Windham Residents Fined $40K for Wetlands Act Violations

Vincent and Linda Bonanno dredged marsh at Cobbetts Pond to install a dock without authorization after a permit was not issued.

CONCORD, NH - The New Hampshire Attorney General's Office and other state officials have approved a settlement in Rockingham County Superior Court against two Windham residents for violation the state's Fill and Dredge in Wetlands Act, according to a press statement.

Vincent and Linda Bonanno will be fined $40,000 for violating NH RSA 482-A for constructing a dock and dredging approximately 9,000 square feet of a freshwater emergent marsh on property that they on within Cobbetts Pond without DES authorization.

"These violations were discovered after the Bonannos were informed by DES that it would not issue a permit for said dredging and construction," according to Mary E. Maloney, an assistant attorney general. "Under the terms of the settlement, the Bonannos will be assessed a total penalty of $40,000. In addition, the Bonannos agreed to retain a Certified Wetlands Scientist to restore the damaged wetlands."

The settlement was approved by the NH Department of Justice, the NH Department of Environmental Services, and a Rockingham County court judge.
