Nutley Loses Lawsuit To Stop Hotel Project: Report

Work on a seven-story, 266-room Marriott AC/Element Hotel will be allowed to proceed at the ON3 campus near Route 3, a report says.

NUTLEY, NJ — Work on a seven-story, 266-room Marriott AC/Element Hotel will be allowed to proceed at the ON3 campus near Route 3 in Nutley and Clifton after a legal challenge delayed the project, a report says.

The Township of Nutley lost a lawsuit to stop the project after it sued the developer, Prism Capital, and the City of Clifton – which approved the final site plan for the hotel and rooftop bar in July 2021, TAP Into Nutley reported last week.

Since the hotel’s footprint is in the Clifton section of ON3, Prism does not need approval from Nutley for the project, Essex News Daily previously reported.

The Township of Nutley and Prism Capital have had a contentious relationship in the past, with Nutley officials threatening to seize parts of the former Hoffmann-La Roche campus via eminent domain in 2021.
