NJ Man's Sub Came With Dentures Inside, Lawsuit Says

BERKELEY, NJ — A Bayville man who unwrapped a Jersey Mike's sandwich delivered through Grubhub to find a set of dentures embedded within has filed a lawsuit claiming negligence, according to court records.

Fernando Rodriguez ordered a sandwich from the Lacey Jersey Mike's through Grubhub in April of 2025, according to court records.

When the food arrived, it was packaged and sealed with tape, the lawsuit said. But when Rodriguez unwrapped it, he found dentures embedded in the sandwich, according to the lawsuit.

"The presence of dentures inside the food rendered the food contaminated, unsafe, adulterated, and unfit for human consumption," the lawsuit reads.

And as a result, Rodriguez "experienced extreme shock, disgust, emotional distress, nausea, loss of appetite, and physical revulsion," the lawsuit said.

The lawsuit accuses the delivery driver of being negligent and "handling food in an unsanitary manner."

The lawsuit also claims that Grubhub does not properly train drivers, and that Jersey Mike's did not properly safeguard the sandwich.

"A reasonable food delivery driver would recognize that opening sealed food packaging and handling food in an unsanitary manner creates a foreseeable risk of contamination and harm to the consumer," the lawsuit reads.

A spokesperson for Jersey Mike's did not immediately respond to a request for comment.

"We were troubled by this report, as it doesn't reflect the high standard of service our customers expect," a spokesperson for Grubhub told Patch. "We can confirm the individual is no longer contracted to deliver with Grubhub."
