Ex-Brick Councilman Accused Of Sexual Contact With Teen Pleads Guilty To Lesser Charge: Report

Dan Toth pleaded guilty to simple assault, according to the report.

BRICK, NJ — A former Brick Township councilman who was accused of sexual contact with a 15-year-old in Jackson has pleaded guilty to a lesser charge of simple assault, according to a report.

Brick Shorebeat reported Dan Toth, 40, pleaded guilty Aug. 30 and has been sentenced to two years of probation in the case, quoting the Ocean County prosecutor's office.

Toth was charged with criminal sexual contact and endangering the welfare of a child and arrested in August 2015 following an investigation that began after the boy reported the incident to police, Al Della Fave, spokesman for the prosecutor’s office, said at the time of the arrest. Toth was accused of rubbing the boy's genitals.

Toth, who had served on the Brick Township Council from 2005 to 2013, had been seeking a seat on the council on the Republican ticket at the time of his arrest. He later withdrew his candidacy but vehemently denied wrongdoing.

The Brick Shorebeat report said the plea to the reduced charge was by agreement with the victim and the victim's family.
