Hearing Pushed To February In Brick On Home Overcrowding Summons

BRICK, NJ — Municipal court hearings on a pair of summonses issued in connection with overcrowding at a Hendrickson Avenue home and a use variance for the former Temple Beth Or have been pushed back to February.

Brick Township Municipal Court Judge Joseph Grisanti scheduled a status conference for January on the summonses that were issued to David Gluck in connection with overcrowding at a home at 91 Hendrickson Ave. and in connection with the dispute over a zoning variance to convert the former Temple Beth Or synagogue to a school for Orthodox Jewish boys.

The delay on the overcrowding summons was the result of a delay in finalizing some discovery that needed to be turned over by the township to Gluck's attorney, municipal code enforcement prosecutor Lani Lombardi said.

Video from a police officer's body camera was anticipated to be turned over this week, she said.

Adam Pfeffer, Gluck's attorney, asked Grisanti to delay action on the zoning compliance summons for the former Temple Beth Or site pending the results of the Dec. 20 Board of Adjustment hearing on the matter and a status conference with Ocean County Superior Court Judge Craig Wellerson.

The zoning board meeting is set for 6 p.m. Dec. 20 at Civic Plaza, 270 Chambers Bridge Road.

Grisanti questioned Pfeffer on the zoning compliance summons, asking whether Congregation Kehilos Yisroel had sought permission for a use change or not, and Pfeffer repeated his request for a delay on the matter.

He said the congregation went ahead with the application because nothing was getting resolved, but that it continues to insist approval of a change of use is not needed, contending there was a school operating at the site previously.

Grisanti said hearings are scheduled to return to in-person appearances in February.
