7:05 p.m.: Meeting has been called to order.
7:30 p.m.: Correspondence with the board. The attorney for one person opposing the application has filed a lawsuit challenging the Planning Board’s jurisdiction over the Ocean Pointe application.
Planning Board attorney Harold Hensel said the lawsuit, filed Wednesday by attorney Ron Gasiorowski, is seeking a determination from a state Superior Court judge on the matter. The lawsuit contends that the variances being sought by Kamson Corporation, the developer, mean the project should be heard by the Board of Adjustment, Hensel said.
The parcel is in a hospital support zone, with a mixed-use overlay that permits other uses but imposes bulk requirements..
The Planning Board, under Hensel’s advice, postponed any further action on the project until there is a determination by a Superior Court judge.
