NJ Gov. Murphy Vetoes Raising Property Taxes To Fix School Aid

NEW JERSEY – Gov. Phil Murphy vetoed legislation that lawmakers hoped would quell the uproar over school aid cuts in New Jersey. But, by encouraging property tax hikes, the new plan could have created a new one.

Murphy vetoed a bill championed by Senate President Steve Sweeney that would have allowed as many as 40 school districts to immediately raise taxes to make up for school funding losses. Ultimately, more than 100 districts may have been able to take advantage of the legislation over the next 5 years (see list below).

"Before middle-class property taxpayers have to again take it on the chin, we should be asking our wealthiest residents to pay their fair share through a millionaire’s tax,” said Murphy.

In Brick, for instance, administrators said they would have to raise taxes 19 percent to make up for funding losses.

Last month, the Senate and Assembly passed the bill by 24-15 and 41-26-4 votes, respectively, with the "yes" votes largely falling along Democratic Party lines. Sen. Richard Codey, the former acting governor, was one of the few Democrats to vote no.

The bill would have allowed for certain school districts to raise property taxes above the 2 percent cap without voter approval. If enacted, the bill would have further encumbered already over-burdened middle and working-class taxpayers, Murphy said.

Murphy then noted his ongoing effort to raise the marginal income tax of those with incomes over $1 million per year from 8.97 to 10.75 percent, as it was as recently as 2009.

“This legislation would have created a loophole in our existing property tax cap by making it easier to raise property taxes,” Murphy said.

Sweeney condemned Murphy’s veto, saying the school cap relief legislation "was developed with support from the New Jersey School Boards Association and school board members, superintendents and school officials from across the state."

“It is the height of hypocrisy for the governor to play politics with the lives of schoolchildren by calling for passage of the millionaire’s tax when he knows — or should know — that not one penny from the millionaire’s tax could legally go to any of the Adjustment Aid districts that would have been helped by this legislation,” Sweeney said.

The 2 percent cap was set by the Christie administration in 2010. A number of school districts have struggled to stay within the cap – especially since the Murphy administration and state Legislature changed the school funding formula in 2018 that brought severe cuts to suburban districts.

Lawmakers say the Sweeney legislation would almost immediately provide cap relief to about 40 out of the 194 districts that received Adjustment Aid cuts this year and are currently spending below the adequacy level defined in the School Funding Reform Act.

Or they would have been districts that fall below adequacy between this year and the 2024-25 school year when Adjustment Aid will be fully phased out. So more than 40 districts may be able to ultimately raise taxes within the next 5 years.

The largest districts that would have currently qualified for cap relief included Toms River Regional, Old Bridge, Brick, Lakewood, South Brunswick, Hillsborough, Rancocas Valley Regional and Leonia. Freehold Regional and Manalapan-Englishtown Regional are among the largest districts that would qualify in future years, Sweeney's office told Patch.

Indeed, Toms River, Brick, Hillsborough and other districts have talked about closing schools, cutting sports programs or taking other drastic steps to make up for the funding losses.

“The governor owes parents and schoolchildren in Toms River, Old Bridge, Hillsborough, South Brunswick and Brick an explanation of why he thinks the adequacy of their education is less important than those of children in cities like Newark and Trenton," Sweeney said.

The New Jersey School Boards Association expressed "extreme disappointment" in Murphy’s veto of the legislation.

“We strongly disagree with the governor’s interpretation of the proposal and its impact on local property taxpayers,” said Dr. Lawrence S. Feinsod, NJSBA executive director. “S-4289 was well-thought-out legislation that would have enabled school districts to maintain educational programming. It would not have resulted in wide-scale, unbridled property tax increases as inferred by the governor.”

Sweeney also said lawmakers will continue to work to consolidate nearly 300 school districts as a way to save money. Read more: Renewed Push On Plan To Eliminate 275 NJ School Districts

Besides Murphy, other lawmakers – particularly Republicans – have cried foul over the idea. Senate Republican Leader Tom Kean said a proposal to lift New Jersey’s 2 percent property tax cap is the wrong answer to counter major school funding cuts that are hitting many districts.

“I disagree with the Senate president’s suggestion that the solution to the school funding crisis is to let property taxes spiral out of control as they did in the years prior to the passage of the successful 2 percent cap,” Kean said. “We need to change the school funding formula in order to help school districts lower some of their largest and fastest-growing costs.”

Sweeney has stressed that the cap relief bill does not change his commitment to ramp up to full funding of the School Funding Reform Act for underfunded districts.

“New Jersey’s public schools are ranked the best in the country, but many schools throughout the state do not receive the appropriate funding required to live up to our reputation,” Sweeney said. “Statewide, 342 districts are underfunded by $1.7 billion and are paying $536 million more in property taxes than called for by the school funding formula. At the same time, 228 districts are overfunded by $659 million. Fairness requires us to move forward to fix that inequity.”

Murphy, however, said he believes that issues as important to New Jersey residents as property taxes and education funding "warrant more deliberation than this bill was given.”

“State-level decisionmakers should not delay difficult funding decisions until the end of the legislative session and fast track what amounts to a tax increase on the middle class without first exhausting all other options,” he said.

Under the 2019-20 school aid plan, about 194 school districts experienced decreases. A number of districts protested the changes, and many of them even appeared at the State House last year, just as Murphy was giving his budget address, to voice their displeasure. State aid weighs heavily in many districts' decisions on raising local property taxes. Many often say that aid cuts or flat spending from year-to-year gives them cause to raise what are already the highest property taxes in the nation.
