Wawa To Pay $1.4M In Back OT After Lawsuit By Brick Man, 3 Others

Wawa has been ordered to pay a $1.4 million settlement of a federal class action lawsuit covering more than 300 employees brought by a Brick Township man and three others over unpaid overtime, according to court documents.

Michael Dinse of Brick was one of four people who worked as an assistant general manager for the convenience store chain who was not paid fully for all the hours he worked, according to the settlement documents.

The lawsuit, filed in January 2017, alleged the company violated the federal Fair Labor Standards Act by making them work more than 40 hours per week and refusing to pay them overtime despite making them do work that was commonly assigned to those who were not in management positions, including stocking shelves, NJ.com reported.

Dinse, along with James Cloud and Christopher Carmany, joined the lawsuit brought by Anthony Gervasio of Burlington County on behalf of all assistant general managers who claimed they were not paid overtime, according to court documents and the NJ.com report.

Gervasio worked for the chain from 2006 to 2016, and Dinse worked for Wawa from 2009 to 2014, the report said.

Wawa changed how it classifies assistant general managers in December 2015, making them eligible for overtime, according to the settlement document. More than 300 employees are expected to receive payments, according to the settlement's administrator, Jennifer Keough.
