"If you can't win on the merits, cheat" - Courts DELAY Emergent Election Matter

Both Parties utterly fail to qualify for preferred "Ballot Lines" in November, yet the Clerks and the Lt. Governor awarded them, anyway.

The Statutes are clear.

To maintain the “preferred real estate” in the left columns of the ballot for General Election, either on the mailed “Sample Ballots”, the “Mail-in Ballots”, “Provisional Ballots”, OR on the Voting Machines, each party is required to meet a demonstrated standard of “community support”.

That standard, set by Statute in Title 19 of our NJ Election Code, is, to all appearances, a fairly low one, at first glance. Surely the two so-called major parties couldn’t fail to meet that standard – could they?

The Statute requires that 10% of the NJ Registered Voters who cast a ballot for ASSEMBLY in the prior year’s General Election, in this case, the 2013 General Election, must darken the doorways of the polling places State-wide and cast a ballot in the JUNE PRIMARY.


ON June 3rd, 199,329 Democrats cast a ballot for the candidate of their choice for the US House of Representatives.

ON June 3rd, 152,686 Republicans showed their support for their party by casting a ballot in selecting their candidate for the US House of Representatives.

Not enough.

The bar, set by Lt. Governor Kim Guadagno in her “Certification of Political Parties”, issued on 12/3/2013, which allowed the two major parties to CONDUCT a State-funded primary election a few weeks ago, was 372,197. That number, per the certification, is 10% of the total votes cast for NJ State Assembly. That is the amount the Statute requires be met or exceeded. The Democrats barely managed half the necessary total, with only 53.55% of the 10% requirement showing up.

The Republicans did far worse, with only 41.02% of the necessary total.

Is the math that difficult?

Apparently.

As a result, the “Democratic-Republican” Organization of New Jersey filed a lawsuit LAST THURSDAY (August 14th) to COMPEL the re-drawing of the ballot in compliance with the statute.

On an emergent election matter, the Courts have seen fit to delay us for nearly a week without assigning a DOCKET #, and tried to assign a CRIMINAL COURTS JUSTICE who is specifically unable to sit for this case, as he was one of the litigants in at least TWO of the cases cited in the complaint.

This was called to the attention of Judge Fleming last Friday afternoon, and, in fact, both he and Judge Mary Jacobson, who was the Judge in the “LaVergne v Lonegan” case, are aware that he is disqualified for his prior involvement. Both Justices were served the attached memorandum calling for Judge Fleming’s recusal, and for immediate appointment of a CIVIL Justice and issuance of the Order to Show Cause, for which we are still waiting. They were served by me at their chambers at 8:30 a.m. this morning, so that there could be no claim that we were a source of delay.


EVERY Federal Candidate is an interested party in this case. EVERY SINGLE VOTER in New Jersey, and, by extension, as these are candidates for Federal Office, where legislation affecting every American is written and passed, will be affected by this action.

The complete contents of the lawsuit and exhibits, which include evidence from the records of the Superior Court, (the Appellate Court records are strangely “missing”/”destroyed”), will be publicly available to be downloaded and read by the general public as soon as a docket number is assigned.


The Two so-called major party bosses and their minions have been caught cheating, and now, it would seem, they are unwilling to let an unbiased judge hear the case. They’re caught, they’re wrong, and they know it. They’re pulling out all the stops, because they can’t control the outcome if they don’t control the columns.


They’re not getting a pass from us. They shouldn’t get one from the voters, either.
