South Jersey Man Sues Police Over Stolen ATV: Report

Daniel Nowakowski claims he was wrongfully arrested, and his vehicle was stolen while he was in police custody.

A South Jersey man has filed a lawsuit against New Jersey State Police, alleging he was wrongfully arrested and that his all-terrain vehicle was stolen while he was in police custody, the Courier Post reports.

Daniel Nowakowski said he was legally riding his ATV on private property owned by a friend when he was arrested for trespassing on Feb. 8, 2015. He also says his ATV was stolen after the arresting officer left the keys behind while taking Nowakowski into custody, according to the report.

The state contends Nowakowski was riding on property marked “No Trespassing” in an area near Wharton State Forest in Burlington County, and was subsequently arrested, according to the report. It doesn’t mention the theft of the ATV.
