NOTICE OF FINAL COMPLIANCE HEARING FOR THE TOWNSHIP OF HOLMDEL, COUNTY OF MONMOUTH WHEREIN THE COURT WILL CONSIDER APPROVAL OF THE TOWNNSHIP’S HOUSING ELEMENT AND FAIR SHARE PLAN AND TO DETERMINE WHETHER THE TOWNNSHIP IS ENTITLED TO A FINAL JUDGMENT OF COMPLIANCE AND RESPOSE PROTECTING IT FROM MT. LAUREL LAWSUITS UNTIL JULY 1, 2025

PLEASE TAKE NOTICE that on April 23, 2020 at 9:00 a.m. there will be a Final Compliance Hearing (the “Hearing”) held before the Honorable Linda Grasso Jones, J.S.C. at the Monmouth County Courthouse, 71 Monument Park, Freehold, NJ 07728-1266 in the above-referenced affordable housing litigation. The purpose of the Hearing is two-fold. First, the Court will consider approving the Township of Holmdel’s Housing Plan Element and Fair Share Plan and all other affordable housing actions required by the Settlement Agreement between the Township and Fair Share Housing Center and the Court’s Orders of Fairness and Preliminary Compliance entered in the affordable housing litigation including an Affordable Housing Ordinance incorporating the State regulations into the Township Code; two zoning ordinance amendments for inclusionary projects in the Township’s Housing Element and Fair Share Plan identified as the Palmer Avenue and Route 35 sites, a one-hundred percent affordable housing project identified as the Middle Road site, in the Settlement Agreements with Fair Share Housing Center and the Housing Element and Fair Share Plan, Spending Plan, Affirmative Marketing Plan, Rehabilitation Program, and Resolutions appointing Administrative Agent and Municipal Affordable Housing Liaison; and secondly, the Court will determine whether the Township is entitled to a Judgment of Compliance and Repose providing the Township immunity from all Mt. Laurel lawsuits through July 1, 2025.

The full text of the Housing Element and Fair Share Plan and all documents referenced herein are available for public inspection and/or photocopying (at requestor’s expense) by requesting electronic versions of these documents form the Clerk’s Office or from counsel identified below during normal business hours at the Township of Holmdel Clerk’s Office, Township of Holmdel Municipal Building, 4 Crawfords Corners Road, Holmdel, NJ 07731.
Any interested third party that seeks to appear and be heard at the Final Compliance Hearing shall have the opportunity to present any position on the Housing Element and Fair Share Plan and all related affordable housing ordinances and resolutions referenced herein. Written objections or comments by any interested person must be filed with the Court at the above address on or before April 16, 2020 with duplicate copies being forwarded by mail and e-mail to the attention of the following:

This Notice is provided pursuant to directive of the Court and is intended to inform interested parties of the Final Compliance Hearing and to inform such parties that they can comment on the Township’s Housing Element and Fair Share Plan and related ordinances and resolutions referenced herein before the Court reviews and evaluates whether to issue a Final Judgment of Compliance and Repose providing the Township immunity from Mt. Laurel lawsuits through July 1, 2025. This Notice does not indicate any view by the Court as to whether the Township is entitled to a Judgment of Compliance and Repose and whether the Housing Element and Fair Share Plan should be approved.
