Howell Settles Lawsuit With 'Fountains' Developer For $130K

The township voted to settle a lawsuit from the developer behind The Fountains, a 100-unit age-restricted housing development.

HOWELL, NJ — The Howell Township Council signed off on a $130,353 lawsuit settlement with the developer of The Fountains project - four proposed four-story apartment buildings in the township - on Tuesday night.

The developer filed an injunction against the township in December after the initial building plan was voted down in September, then put back on the agenda and tabled multiple times until it was finally rejected at the end of October.

According to the council, the development was initially rejected because of complaints that the structure was too tall and did not fit with zoning regulations. The proposal has now been "grandfathered" into older, more tolerant regulations, said township officials.

The settlement agreement was the last roadblock for the developer, 6461 Route 9 Howell LLC, to build 100 age-restricted housing units on Route 9 near Howell’s border with Lakewood.
