Lacey Zoners Shoot Down Businessman's Request To Sell Guns
The owner of Jersey Sportsman sought a variance to sell firearms.

Lacey Board of Adjustment members have nixed a request by a local business owner by a split vote of 4 to 3 to sell guns in his South Main Street store, according to app.com.
William Malcolm, the owner of the Jersey Sportsman, says not allowing the sale of guns in his store violates his Second Amendment rights.
"I have a lot of customers that come in and buy ammunition, Lacey residents and they ask me on a regular basis, when are you going to sell firearms," Malcolm told the board.

But Lacey Community Development Director Christopher Reid said the board must consider whether a gun store would conform to the township's master plan and current zoning regulations.
"This is not a hearing regarding Mr. Malcolm's qualifications to sell guns. His qualifications are undisputed," Reid told the board. "Unfortunately, that's not for the board's determination. This is a land use issue."
Selling firearms is not permitted in Lacey's C-150 zone.

It was the second time this year the board ruled against Malcolm's request. Earlier this year his attorney said that it was a permitted use. Malcolm has said that a nearby smoke shop and palm reader are businesses that were not specifically approved for the C-150 zone.
Malcolm said last night's vote would not deter him from fighting for what he said is his right to sell guns.
"Firearms commerce is a Second Amendment issue and it's not going to end here," he said.
