Burlington County Dump Truck Driver Indicted in Mercer County Man's Death
Daniel C. Everett was indicted on one count of second-degree death by auto in James McLean's death.

A Burlington County man has been indicted in the death of 59-year-old James McLean, of Trenton, in July 2014, Acting Mercer County Prosecutor Angelo J. Onofri said on Thursday.
Daniel C. Everett, a 39-year-old dump truck driver from Westampton, was indicted on one count of second-degree death by auto.
Everett was driving a dump truck north on Brunswick Pike at around 3:08 p.m. on July 17, 2014 when he rear-ended a silver Nissan Altima that was stopped at a red light at the intersection of Lake Drive.

The Altima was pushed into Colonial Lake and became submerged.
Special services teams, emergency medical workers and hazmat crews from Lawrence, Princeton and Trenton worked for hours to free both vehicles from the 4-5 foot deep lake.

McLean was pronounced dead at the scene. There were no passengers in either vehicle.
Witnesses told police Everett was speeding and driving erratically when he hit the Altima.
Thursday’s indictment was the result of an investigation by the Lawrence Township Police Department and the Mercer County Prosecutor’s Office Serious Collision Response Team.
Everett faces a maximum sentence of 10 years in state prison.
He is free on $100,000 bail.
