Monmouth County Man Admits Sexually Assaulting 2-Year-Old, Recording Attack

A Howell man has pleaded guilty to charges he sexually assaulted a toddler and electronically recorded the attack, Acting Monmouth County Prosecutor Christopher J. Gramiccioni announced.
Kevin Motyka, 23, of Overlook Terrace in Howell, pleaded guilty to first-degree aggravated sexual assault; three counts of second-degree endangering the welfare of a child by causing or permitting a child to engage in child pornography, manufacturing child pornography and distributing child pornography; and one count of third-degree endangering the welfare of a child by engaging in sexual conduct with a child, Charles Webster, spokesman for county prosecutor’s office, said Tuesday afternoon.
Motyka was arrested in February 2014 following an investigation by the Monmouth County Prosecutor’s Office Computer Crimes Unit, prompted by tips from the National Center for Missing and Exploited Children. The investigation revealed Motyka sexually assaulted a 2-year-old boy between May and December 2012, and created photographs and video recordings of the attacks. The defendant also distributed child pornography of images that did not include his young victim, Webster said.

Under the terms of a plea agreement, Motyka faces a sentence of 13 years in New Jersey state prison and, pursuant to the No Early Release Act, must serve 85 percent of his sentence or approximately 11 years, 2 months and 20 days before being eligible for release on parole, Webster said. He also will be under parole supervision for five years following his release from state prison and subject to the provisions of Megan’s Law and Parole Supervision for Life.
Sentencing is scheduled for June 5 before Monmouth County Superior Court Judge Anthony J. Mellaci Jr. Motyka is being held at the Monmouth County Correctional Institution in lieu of bail set at $700,000 with no 10 percent option.

The case is assigned to Monmouth County Assistant Prosecutor Margaret Koping of the Office’s Computer Crimes Unit. Motyka is represented by Raymond Santiago of Freehold.
