5 Face New N.J. College Frat House Gang Rape Allegations

A N.J. college student says she was lured into a frat party and raped by members of a fraternity. Five have been indicted.

A woman who attended a New Jersey college two years ago claims she was lured into a frat party and raped by members of the fraternity and other students while others enabled the assault, according to a federal lawsuit filed in U.S. District Court.

The woman, identified as "Jane Doe" of Passaic County in the lawsuit, said she was 19 on Nov. 14, 2014, according to nj.com, when members of the Pi Kappa Alpha fraternity at Ramapo College called her into their party from a balcony at The Village Townhouses.

Once intoxicated and passed out, Jane Doe was allegedly laid out on a bed as the frat members played the juvenile game of "Rock, Paper, Scissors" to determine who would get to sexually assault her first, according to nj.com.

Several male fraternity members physically and sexually assaulted her while others stood outside the door and did not intervene, according to the suit. "Incredibly, rather than helping, (the defendants) watched and celebrated the assaults," according to nj.com's account of the lawsuit.

The teen was involuntarily moved without her shoes, underwear and jacket across campus to Mackin Hall, according to nj.com, where she was raped by others.

Four men and and one woman, who have been indicted in the alleged sexual assault of a Ramapo College student, were named in the suit. Cathy Davey, a spokeswoman for the college, told Patch that "Ramapo College has not yet been served with this lawsuit. As with any litigation, the college cannot comment on it."

Nakeem D. Gardner, 18, of Paterson, and Christian A. Lopez, 24, of Secaucus, were arrested after an adult female student of Ramapo College reported to Hackensack University Medical Center on Nov. 15, 2014 and said she had been sexually assaulted, according to the Bergen County Prosecutor's Office.

Justin Sommers, 18, of Staten Island, New York, Christopher Rainone, 18, of Staten Island, and Jordyn Massood, 18 of Wayne, were also arrested in connection with the alleged assault, according to the BCPO.

The status of those cases was not immediately known Tuesday.

Detectives responded to the hospital to interview the victim and learned the woman had attended an overnight fraternity party. She awoke "in a state of undress in a dorm room on the college campus and believed she had been sexually assaulted,” according to the BCPO.

An investigation by the Bergen County Prosecutor’s Office Special Victims Unit and the Mahwah police department, aided by Ramapo College’s security department, resulted in identifying individuals who were allegedly present near the dorm room where the incident took place.

Investigators were able to identify the first two suspects after reviewing video surveillance on campus and interviewing numerous students. It was also confirmed “that the victim was highly intoxicated and unable to consent to sexual activity,” according to the BCPO.

Gardner was arrested on campus without incident, while Lopez was arrested at his residence in Secaucus. Both men were charged with two counts of first-degree aggravated sexual assault. Gardner was also charged with the third-degree crime of invasion of privacy for taking video and pictures of the victim without her consent.

Sommers and Rainone were charged with endangering an injured victim and invasion of privacy, third-degree crimes. Massood is charged with endangering an injured victim. The three were arrested without incident on the Ramapo College campus.

The BCPO says the charge of endangering an injured victim alleges that each aided or encouraged Lopez and Gardner during the sexual assault. The charge of invasion of privacy alleges that Sommers and Rainone took pictures of the victim without her consent.
