Stop the Manalapan Crematorium

What's going to happen at the Manalapan Planning Board meeting on Thursday, 7/28/2016 at 7:30 p.m.? First, we hope you will be there early at 7:00, bring five friends, and meet the leaders of Stop the Manalapan Crematorium. Your presence matters! The Old Tennent Cemetery's crematorium proposal is on the agenda. Ordinarily, the applicant's attorney will present their proposal and witnesses and the Planning Board members can ask questions. Additionally, objectors to the proposal (such as us) can also present our case, and the public can weigh in during the time allocated for public comment. However, there is an additional, threshold argument that will be considered on Thursday. Attorneys for both the Old Tennent Cemetery and Stop the Manalapan Crematorium have submitted legal briefs on the question of whether or not this proposal should be heard before the Planning Board or the Zoning Board. In short, the Zoning Board hears requests for variances from the current zoning law (the Master Plan), and the Planning Board considers changes to the Master Plan. Our position is that this proposal should not even be heard before the Planning Board but instead should be transferred over to the Zoning Board. The applicant believes they have applied in the right place. It's complicated, but if we win, the application will be transferred to the Zoning Board and testimony will likely not be heard on Thursday. No matter what happens, the side that loses the argument will almost certainly appeal to the New Jersey Superior Court.
