The woman said she had an appointment with Kuan at 5:30 p.m. Jan. 24, a Wednesday. She was there for an acupuncture treatment, and she said she had seen Dr. Kuan for acupuncture treatments before.
She said he told her to take off all her clothes, and he gave her a gown. She said she found this unusual as she had never been asked to fully unclothe in any prior sessions. He instructed the victim to lie facedown on the treatment table.
She said he gave her the initial acupuncture treatment by placing needles in the back of her legs.
The woman then said Kuan advised "he was going to access her perineum, and before the victim responded, he inserted an ungloved finger into her anus and moved it around for several seconds."
"The victim advised that she was scared to move because she had needles in her legs," read the affidavit.
Kuan then removed the needles and instructed the victim to flip onto her back. He again put needles into her legs — this time the front of her legs — while asking if she had any vaginal discharge.
"The victim responded by saying 'no,' at which time the defendant said to the effect that he was going to check, and even after the victim denied any discharge and did not provide consent, the defendant spread the victim’s labia with his hands and visually inspected her vagina."
The woman contacted Matawan Police the next day, Jan. 25, and reported what happened as alleged sex assault.
Kuan was arrested without incident on Feb. 1, by members of Matawan Police and the Monmouth County Prosecutor's office Special Victims Unit. He was charged with one count of second-degree sexual assault and one count of fourth-degree criminal sexual contact.
Nobody picked up the phone at Kuan's Prosperity Health clinic Monday.
Investigators are seeking additional information about Dr. Kuan’s activities. Anyone with information is asked to contact Monmouth County Prosecutor’s Office Detective Joseph Mason at 800-533-7443 or Matawan Police Department Detective Michael Denino at 732-290-2038.
