Oakland Cop Charged With DWI, Assault In ATV Crash: Prosecutor

OAKLAND, NJ — A borough police officer was charged with two counts of assault by auto and driving while intoxicated after he crashed an all-terrain vehicle and seriously injured someone, authorities said.
Daniel Kern, 36, was arrested Friday after he crashed the ATV Sept. 17 at Fordham and Tulane Roads, said acting Bergen County Prosecutor Dennis Calo.
Oakland police officers responded to a 911 call of a motor vehicle crash there. Kern and Michael Fahy, 37, of Franklin Lakes, were there and Fahy told officers that he was driving the ATV when it crashed, Calo said.

Fahy was passed field sobriety tests and was issued several motor vehicle summonses, Calo said.
The Oakland Police Department later received information that Kern was driving the ATV when it crashed and the case was referred to the Bergen County Prosecutor's Office, Calo said.

As a result of an investigation by the prosecutor's office, Kern was charged with the two counts of assault by auto, DWI, operating an ATV on a public road, operating an ATV without a helmet, failure to provide information following a motor vehicle accident, and reckless driving.
Fahy was charged with hindering apprehension and prosecution.
