Barberio’s Election Challenge Denied, Again: Here’s Why

The former mayor's latest attempt to challenge the November election has once again proved fruitless.

PARSIPPANY, NJ — Former Parsippany Mayor James Barberio’s fourth attempt to challenge the Parsippany Mayoral Election results has been denied.

In a motion for a judge to reconsider a previous denial, filed on Jan. 9, Barberio’s legal team attempted to offer additional evidence to their claims, after one judge found the initial attempt was filed “without any factual or evidentiary support.”

The judge also claimed that Barberio’s challenges were filed "haphazardly,” and that the "evidence" is “without merit.” Specifically, the court said that Barberio claimed that there were 155 unverified voters in the election; however was unable to procure anyone who could testify that their votes were unverified.

While the judge’s ruling was denied with prejudice, meaning Barberio could not file to challenge again, he was able to file for a reconsideration of the ruling, which is what he did on Jan. 9.

However, a motion for reconsideration is not an opportunity for the litigator, in this case Barberio, to change or add evidence to what was initially filed. It instead gives the court the opportunity to re-analyze what was already presented.

"The Court rejects (Barberio’s) motion for reconsideration to the extent that it raises new arguments and/or presents evidence that was available, but not presented, in connection with the Dec. 22, 2025, hearing,” the most recent ruling reads. “This court also rejects the information as a basis for reconsideration, as it should have been raised during the Dec. 22, 2025, hearing.

"While the petitioner's assertions may be based upon 'belief,' it has been confirmed that the petitioner's assertions are not based upon any information,” it continues.

Essentially, Barberio’s legal team attempted to include additional evidence in their motion to reconsider, which could only be looked at if it was in the initial motion to challenge the election. Based on the evidence that was already filed, the judge’s decision to not challenge the election stands.

If Barberio were to continue his attempt to challenge the election, he would need to file an appeal with the Appellate Court.
