Jenkinsons Versus Army Corps Of Engineers Lawsuit Hearing Postponed Again

The new hearing date is slated for July 19.

A hearing in U.S. District Court on the lawsuit filed by Jenkinson’s Pavilion against the Army Corps of Engineers over the federal beach replenishment project has been postponed again, according to the Ocean Star.

The project runs from the Manasquan Inlet down to Island Beach State Park in Ocean County and involves widening beaches and building dunes.

The lawsuit - which also names the state Department of Environmental Protection and Point Pleasant Beach - was filed in December. Jenkinson’s owns the bulk of the oceanfront in Point Pleasant Beach, not the borough.

The hearing was originally scheduled April 22, but was postponed to give all involved more time for discussion.

“The project design documents provided to plaintiffs by representatives of NJDEP during meetings … do not contain any reference to, or require any action concerning, the creation of public beaches in perpetuity upon private property,” the suit states.
