Marc Weber Dentist NJ indicted with office Manager 9/2009 and Board Dentistry of NJ requests Dr Weber temporarily surrender Dental license pending outcome of indictment.

John Flynn Esq. (Marc Weber lawyer with Robert Stevens Esq. and Richard Tanner) answered that the indictment was seriously flawed and have every reason to believe Marc weber dds will be found Not Guilty. He would have the Contract of Sale and had known that Weber's lawyer with new owners' lawyers had an Escrow account which Weber informed the State Board of in writting and verbally left messages to detectives making them fully aware of Dr Webers' placing over $300,000 of his own money for any patient requesting a refund for any reason . In addition the Contract of Sale Dr Weber was attempting to have Ralph Anillo read stated that the new owner insisted he be the DR who presented the refund to "HIS" patients. Thus making himself De Facto responsible person to "HAND" the refund to the patient. If this wasn't enough to dismiss charges, unlike the Grand Jury who agreed to indictment, the TRIAL Jury & Judge now had our mutually agreed Contract of Sale. Dr Weber had paid & placed $300,000 to Escrow for Perfect Smile owners who insisted be the "RESPONSIBLE " entity to contact and issue these patients refunds and not Dr Weber.

It is important to know the office Manager Jennifer wasn't investigated as a target until 2008 when she became Dr Webers' wife. They used her as leverage to force a plea agreement by doubling Webers legal fees and trials are expensive on a Dentist salary.gather all the facts and apply basic Common Sense when a Professional Detective well trained and in good standing makes a decision to request a start to a $3.8M State paid Investigation . Public Information shows the total amount of these patient refunds were %0.4673 of what Marc Weber dds NY NJ was paid for just this 1 of 3 NJ clinics and building. This is estimated and after debts, loans,leases and the small 10 year Mortgage left on the building.

Weber would show the Jury the what the Grand Jury was not informed of.

The most disturbing is that there never was a theft since Weber would have needed to break NJ State and Federal Laws to refund these 4-5 patients himself despite no longer being his responsibility. HIPPA and our civil Agreement prohibited Weber from removing Private Information held at the Dental office now purchased by Perfect Smile. State HIPPA laws strictly forbids anyone removing these patients' records with CONTACT INFORMATION. The point is NJ State created Hostile witnesses out of these patients who came in person or called the new owners office and phone number requesting a refund . Detective Anillo was caught lying about this as he testi-LIED at trial. This caused a very smart inquisitive Judge Melacci to question what really was the purpose why we we were at all here? The Judge stopped to ask the Detective while testifying to locate his notes regarding these 4-5 patients or any notes related to Dr Webers messages left for Det. Anillo and Marc Weber dds on record informing NJ Board of Dentistry of Weber leaving $300,000 for refunds to any patient for anty reason. Weber goes on to express the purpose of leaving a ridiculously high amount of $300,000 was to be overly safe that he wasn't running away with patient money. Yet this was exactly what NJ state Board tried to portray Weber as. All parties except the patients were informed of all of the above yet allowed $3.8M to be wasted investigating Dr Weber while he attempted to speak to Detectives but was ignored. He had to personally go to Newark to be heard officially on record with the State Board of Dentistry The State Lead Det. R. Anillo refused to return Dr Weber's calls as did James Flanagan D.A.G.

We all have watched Law & Order or some crime shows. What cop would miss the opportunity to meet with and talk to the target of his/her investigation before he even retained a lawyer? The Judge sniffed something was off causing his request to see the Detectives notes. The lead Detective of this $3.8M investigation and now only the 2nd Dentist in NJ to refuse a deal actually lied to the judge answering with "I don't have any notes". The Judge with a hard to keeep stone face excused him from the stand wiping out his testimony.

DR Weber left multiple messages that he wanted to show the Contract of Sale of Weber Dental Associates prior to the theft he was accused of. Patients were told by new owner Andrew Moron dds, that Perfect Smile was owned by Weber until 5/2008.

Lead D.A.G James Flanagan behaved so non professionally at closing statements due to his frustration the Judge Mellacci was forced to stop his closing statement twice due to using slanderous language and poor behavior. The Deputy Assistant Attorney General was stopped during his summation when he turned to Dr Marc Weber and began yelling at him. When a State Attorney General NJ is yelling directly at a defendant silly non productive statements as "Look at you" , "You are an animal" and his lead detective, lead witness and all 4 patients were all excused for either lying (I assume the State witnesses can't be punished for lying under oath?) or telling Judge Melacci or Weber's Lawyer "They told me how many or the Detective Ralph Anillo answered Judge Mellacci's request to look at his notes to verify his testimony matched , that he doesn't keep notes- Someone targeted Marc Weber dds and if it wasn't the A.G. James Flanagan D.A.G. who suddenly retired after this case then who did Judge m think it was? A trial was definitaly not supposed to take place since the only Dentist to refuse to accept a plea was Dr Sharrow of Manalapan who was sentenced to 3 years in a State Prison. He also is going into his wife's family Jeans Business. I am not giving the name for fear of reprisals. Dentists can't afford trials especially if a wife is also charged but this family has so much money that if compared to the price I received for all my practices and real estate were combined ? That amount compared to Dr Sharrow's family would be Statistically Insignificant!

$ 3.6 Million Dollars investigating Weber from 2004-2010, the harassing Marc Weber as he treated patients at his Job and scare tactics used by pulling over Weber's former employees while driving home or his ability to have simply returned Dr Weber's calls and read that his lead witness was actually the owner and/or was given over $300,000 to reimburse any patient who didn't want to continue on with the new owner but was partially paid as is by law the correct method . For example if a patient was coming once a month for Teeth Straightening and had 6 monthly payments left but HATED the new office ? Weber told the Dental Board in an effort to expedite leaving NJ for his NY offices he'd just give Blanket Refunds & at no cost finish or adjust or correct or adjust his associate dentists patients' dental work 3 days a week for 1 year in a treatment room rented from the new owners.
