At 5:30 p.m. on Friday, police found Simmons and his vehicle on Route 33 in Neptune, and investigation determined that while the item brandished by Simmons resembled the barrel of a firearm, it was not an actual firearm.
Though the item turned out not to be a firearm, police said further investigation revealed that Simmons was unlawfully in possession of a pepper ball gun and a replica firearm, in violation of “Certain Persons” statutes.
Simmons was then arrested and charged with fourth-degree certain persons not to have weapons, third-degree terroristic threats, and a disorderly persons charge of simple assault, police said.
Simmons was brought to Wall Township Police Headquarters for processing and lodged at the Monmouth County Correctional Facility.
On Saturday, he was released from custody pursuant to NJ Bail Reform guidelines, police said.
