Westfield Sued Over Slip-And-Fall That 'Severely' Injured Resident, Lawsuit Claims

Marie Regina claims she had severe and permanent injuries, endured great pain and suffering, and expended money due to the fall.

WESTFIELD, NJ — A Westfield resident has sued over an alleged trip-and-fall in Municipal Parking Lot No. 5.

Marie A. Regina of Westfield filed the lawsuit on July 21 in Union County Superior Court.

Regina alleges she fell on Nov. 4, 2025, at the municipal lot at 116 Elmer St.

According to the complaint, Regina was a business invitee at the lot when she encountered what the lawsuit describes as a dangerous condition.

The filing alleges the area included "a large pothole, deteriorated and broken asphalt, uneven pavement, and other hazardous surface defects immediately adjacent to the driver's side of Parking Space No. 5 within Municipal Parking Lot No. 5."

The complaint alleges the Town of Westfield was responsible for the ownership, operation, repair, design, maintenance, use or supervision of the property.

It also alleges the pothole and deteriorated asphalt constituted a dangerous condition of public property and that the town created the condition or had actual or constructive notice of it.

"As a direct and proximate result of the negligence of the Defendant, Town of Westfield, as aforesaid, Plaintiff Marie A. Regina sustained severe and permanent injuries, endured great pain and suffering, expended great sums of money in order to cure her injuries, and suffered a loss of income," according to the lawsuit.

The complaint seeks damages, interest, costs of suit and attorney's fees. The case includes a jury demand.

The Town of Westfield did not immediately respond to Patch's request for comment.
