Builder’s Remedy Lawsuits Pile Up In West Orange

WEST ORANGE, NJ — West Orange is currently facing six separate “builder’s remedy” lawsuits from real estate developers as the town pushes to add more affordable housing.

Builder’s remedy suits allow developers to seek court approval to bypass local zoning laws and build higher-density residential projects – as long as they provide a certain number of affordable housing units.

West Orange is on the hook for 409 “present need” units and 660 “prospective need” units over the next decade, according to the state’s latest affordable housing quota.

The lawsuits, which are available online at the New Jersey Courts website, were also recently shared by town council member Joe Krakoviak.
