Westorange.info Versus Westorangeinfo

The legality of the "cease and desist" letter has been debunked by Atty. Stephen Kaplitt. A new twist came up at the June 25, 2013 meeting - westorange.info could cause "confusion" since it is very close to westorangeinfo, which is the official handle of the town's Facebook, Twitter, Youtube and Instagram. In other words, the Administration claims that westorange.info could be mistaken to be the Official West Orange website.

When one wants to search for the Official website of West Orange, he/she would enter on the browser search field, something like West Orange, NJ or West Orange New Jersey, or just West Orange (not a good practice since there are many West Oranges in the US.) I tried these using the three most popular browsers - Internet Explorer, Google Chrome, and Mozilla Firefox. In all cases, only the Official website of West Orange came up.

I then did the search, using the three browsers for westorangeinfo and westorange.info. When searching for westorangeinfo, only the Official West Orange website shows up. When searching for westorange.info, both will show up next or almost next to each other, BUT, the Official website of West Orange will have a header - West Orange, NJ - Official Website whereas westorange.info's header will be West Orange Info I Information about West Orange, NJ.

The key is that the official West Orange website has "Official Website" on the header. If anyone else also appends "Official Website" on the header of their website, be it Mr. Freivald's westorange.info or something else, then that would be malicious or criminal, and can really cause confusion. Therefore, my conclusion is that the use of westorange.info will not result in it being taken to be the Official West Orange website.

What I am saying might be made clearer if you try to do the searches yourself. Maybe you have a different browser from the three that I used. Let me know if your results do not agree with mine.
