Susan Yudin Appealing Court Ruling Favoring Independent Candidate

Judge denied her challenge of Thomas Madigan's petition earlier this month.

Republican Township Committee candidate Susan Yudin has appealed a Superior Court ruling issued earlier this month that validated her opponent’s nominating petition.

Yudin, who is seeking one of two committee seats in the general election, had her complaint dismissed with prejudice last week by Judge Estela De La Cruz. Yudin filed the appeal Monday.

Yudin claimed that because independent candidate Thomas Madigan did not witness all of the of the 194 people sign his petition that it should have been deemed invalid. She also challenged Magidan’s ability to sign both his and Republican Kevin Rooney’s petitions.

Yudin said she is appealing the decision because ”we want to know if it is still required for the circulator to witness signatures on a petition.

“Also, I do not understand why Mr. Madigan is upset that I appealed a decision of the court,” Yudin said. “He himself has previously appealed court decisions on his own behalf.”

Yudin also filed for a stay of printing the election ballot with the Bergen County clerk’s office so her appeal could be heard. The ballots, with Madigan’s name on them, were to be printed Thursday, NorthJersey.com reported.

Yudin said that all legal fees are being paid for my her and her campaign.

Madigan told NorthJersey.com that it is “totally bizarre” that Yudin would appeal “the sound judgement of the courts.”
