Here are the top stories in Albuquerque today:

  1. A man accused of killing his wife earlier this year is now back on the streets, all because of a technicality in court. Jerome Gutierrez, 54, who is accused of beating his wife, Kristy Rivera, so badly she was left brain dead, was released late last week. Now, the defense, prosecutors, and courts are all pointing the finger at each other for making the mistake. In June, his defense attorneys requested the detention hearing be delayed until they got more details about the victim from the medical examiner but a hearing was never scheduled within 60 days, denying him his right to a speedy hearing. (KRQE News 13)
  2. A poll released Tuesday by The Paper conducted by Public Policy Polling is giving us a preview of where the mayoral race stands. The poll shows 53 percent of voters said they aren't sure who to vote for, or they aren't voting for Mayor Tim Keller. "Tim Keller has 47 percent, Manny Gonzales 21 percent, Eddy Aragon 11 percent and not sure 21 percent," said Adrian Carver, with The Paper. The poll suggests Mayor Keller has some work to do if he wants to secure the spot. (KOAT New Mexico)
  3. On Oct. 23, the Smithsonian traveling exhibit, "Righting a Wrong: Japanese Americans and World War II" will be open to the public at National Museum of Nuclear Science & History. This exhibition will highlight the impact of Executive Order 9066, which resulted in the incarceration of Japanese Americans after the attack on Pearl Harbor (KRQE News 13)
  4. An APD officer found a father and 4-year-old son stranded, scared, and homeless at a transit center and helped them find a place to call home. (KOB)
  5. In 2021 so far, the APD has lost 118 officers, with more than 40 resignations. (KOB)
