ICYMI: Commack Schools To Keep Ownership Of Historic Farm: Report

In case you missed it, here's a story that appeared last week in Commack Patch:

After a yearlong legal battle, a New York state Supreme Court justice recently ruled that the Commack Public School district will continue to own the 9-acre Marion Carll Farm, according to a report in Newsday.

Carll left the district the farm after her death in 1968 on the condition that it be preserved, maintained and used by the district to educate children about the way families operated farms in Long Island in the 19th century.

Her relatives sued the district in 2012 claiming the district did not meet her conditions, Newsday reports.

However, Justice Daniel Martin ruled that Carll's relatives made the decision to take back the property too late since New York State’s property law requires appropriate legal action be taken at least 30 years after possession of a property, according to Newsday.

The farm, located on Commack Road, dates back to 1701 and is currently on the National Register of Historic Places.

In 2009, the district proposed selling Carll Farm to the Holiday Organization, a developer that plans a mixed-use, residential center for the 9-acre farm, sparking protests from local residents.
