Man Facing Felony DWI Charges: Police

The drunk driver was also speeding, police say.

AMAGANSETT, NY — A Seaford man is facing felony driving while intoxicated charges after he was seen speeding in East Hampton, police said.

According to East Hampton Town Police, Nicholas J. Maggio, 28, was arrested on July 16 at 5:02 a.m. and charged with DWI, previous conviction of designated offense within 10 years, a felony, and aggravated DWI per se, .18 of 1 percent or more alcohol, 1 prior conviction, 10 years, a felony.

Maggio was driving a gray 2016 Toyota 4Runner west on Montauk Highway near Windmill Lane in Amagansett, going at a speed of 50 miles an hour in a posted 30 mile per hour zone, police said.

Upon contact, Maggio was found to have the strong odor of an alcoholic beverage on his breath, bloodshot, glassy eyes, and slurred speech; he was unsteady on his feet and performed poorly on all standardized field sobriety tests administered, police said.

He had previously been convicted of DWI in September, 2011, police said.

Maggio was released into the custody of the Suffolk County Sheriff's Department, police said.
