HUNTINGTON STATION, NY — A Huntington Station man was indicted on illegal firearms charges after authorities found multiple loaded guns, ammunition magazines and firearm-manufacturing materials at his home, Suffolk County District Attorney Ray Tierney said.
Matthew Hibner, 36, was indicted on five counts of second-degree criminal possession of a weapon, class C violent felonies, and three counts of third-degree criminal possession of a weapon, class D violent felonies, prosecutors said.
Authorities searched Hibner’s residence on May 14 and recovered four loaded illegal rifles, a Tramps Terror revolver and two illegal ammunition magazines, prosecutors said.
Investigators also found firearm-manufacturing materials, including gun tools, four pistol kits with assembly instructions, unserialized lower and upper receivers, and tools and parts needed to assemble additional firearms, prosecutors said.
Two of the four rifles and numerous lower and upper receivers did not have serial numbers or a manufacturer’s name as required by law, prosecutors said.
Two ammunition magazines recovered were considered “large capacity” under New York law because they could hold more than 10 rounds of ammunition, prosecutors said.
The Suffolk County Crime Laboratory tested the firearms and found them to be operable, prosecutors said. Hibner did not have a permit, license or other legal authority to possess the weapons that were seized, prosecutors said.
Hibner was arraigned Thursday before Supreme Court Justice Philip Goglas, who ordered him remanded while the case is pending, prosecutors said.
Hibner is due back in court on July 9. He faces up to 15 years in prison if convicted of the top count, prosecutors said.
He is represented by The Legal Aid Society, which did not immediately respond to a request for comment.
“It is alleged that this defendant possessed firearms and magazines that are illegal under New York law, including firearms that had no serial numbers,” Tierney said. “Responsible gun ownership is paramount to ensuring safety within our community, and we thank our law enforcement partners for their swift response in this case.”
