Kristin Sculley Court Appearance Adjourned To Aug. 25, Discovery Should Be Completed By Then, Judge Says

GARDEN CITY, NY — Robert Bogle, the judge in the Kristin Sculley murder trial, adjourned the proceedings until Aug. 25 Friday.

Sculley did not appear in court Friday, while members of both hers and Robert Carragher's families were present in the gallery.

Sculley is charged with second-degree murder in relation to Carragher's June 1 death, in which the state said she stabbed the 28-year-old while he was sleeping.

According to prosecutors, Carragher awoke after the stabbing, climbed stairs to the first floor of his home and called to his parents for help. After unsuccessful efforts to stop the bleeding, prosecutors said Carragher died in his father's arm in the family's kitchen.

Sculley's attorney, Dennis Lemke, has disputed the state's account of events, saying Carragher was not stabbed in his sleep but rather that Sculley stabbed him after being drugged and sexually assaulted earlier in the night.

In comments made after Friday's appearance, Lemke said he expects to receive grand jury minutes, police body camera footage, medical information and information on the testing of vapes that were present the night of Carragher's death before the Aug. 25 court appearance.

In a previous appearance, Lemke said Carragher had given Sculley a vape with an unidentified substance that made her feel "basically paralyzed" after use, and had sexually assaulted her after she used the vape. The state has disputed the claim of assault, saying "the evidence in this case shows otherwise."

Police said that there were no drugs found in Carragher's home the night he died, but that there was evidence of some drug use taking place that night.

As for the body cam footage, Lemke has previously said in court that Sculley told officers "right away" that she had been sexually assaulted the night of Carragher's death.

Bogle told the court that he expects discovery in the case to be "basically completed" by the Aug. 25 appearance, allowing the court to discuss pretrial hearings, motions and other considerations that day.
