
On June 6, 2016, New York State Police arrested David D. McCarthy, Â 59, of Montgomery, New York, for Driving While Intoxicated.Â
The charge was a Class E Felony due to a previous DWI related conviction within the preceding 10 years. Â
Troopers were contacted by a Good Samaritan who reported that there was a man driving a red Buick on Interstate 84 who appeared to be drinking a beer while he was driving. Â

The suspect vehicle was stopped on I-84 and police concluded the driver of the vehicle, McCarthy, was intoxicated at the time of the traffic stop.Â
He provided a breath sample that revealed a Blood Alcohol Content of .09% and was arraigned in the Town of Fishkill Justice Court. McCarthy was released on his own recognizance and directed to appear in the City of Beacon Court on June 15, 2016. Â
