Felony DWI Charges For Newburgh Man: NYSP

Police said the man had previously been convicted of driving while intoxicated in the past 10 years.

CORNWALL, NY — A Newburgh man is facing felony charges after being accused of drunken driving.

The New York State Police said troopers stopped a car shortly before 6 a.m. Monday on Interstate 87 in the town of Cornwall for a traffic violation.

Hosmar J. Garcia Giron, 23, of Newburgh, who was the driver, was found to be intoxicated, police said.

He was taken into custody and processed at the Newburgh barracks, where his blood alcohol content was determined to be 0.18 percent.

Additionally, Giron was found to have a prior conviction of driving while intoxicated within the last 10 years, police said.

As a result, he was charged with driving while intoxicated and aggravated driving while intoxicated, both felonies.

Giron was turned over to a sober third party and released on appearance tickets returnable to the Town of Cornwall Court Sept. 8.
