Gang Assault Earns Nyack Man 9 1/2-Year Prison Term

Harrison Whitehead, 26, of 7 Highview Court, Central Nyack, NY was sentenced Aug. 6 before New York State Supreme Court Justice William A. Kelly to a state prison term of 9 1/2 years and 5 years post release supervision after a jury convicted him of Gang Assault in the 2nd Degree.

District Attorney Thomas P. Zugibe said that on April 5, 2013, at about 3:30 a.m., Whitehead and at least six other individuals surrounded a man who had been speaking to a woman and two of her friends in Nyack.

Whitehead punched the victim in the face, while others joined in the violent attack. The victim suffered a broken jaw in the incident, which required surgery and a seven-week recuperation.

Whitehead had been convicted in 2008 of Assault in the Second Degree, a class “D” Felony—making him a violent predicate felony offender.

Senior Assistant District Attorney Janine Kovacs and Assistant District Attorney Michael Dugandzic prosecuted the case.
