A dispute over food and service at the led to the arrest of a Congers man and a New Jersey man on charges they fought with the diner staff and smashed tableware, according to Clarkstown police.
The fight took place about 2:15 a.m. Sunday at the diner on Route 59. Police said the diner night manager complained that Ricardo Perez, 30, of Cliffside Park, NJ, and Anibal Rosa, 37, of Congers, started a fight with the staff and then started destroying diner property including plates, glasses and condiment bottles.
Police said they broke up the fight and arrested Perez and Rosa, taking them to Clarkstown police headquarters in New City.

Both men were arraigned in Clarkstown Town Court in New City, with Rosa ordered held in the Rockland County Correctional Facility without bail and Perez ordered held in the jail on $5,000 bail.
Perez is accused of third-degree criminal mischief, a felony, disorderly conduct and harassment. Rosa is charged with second-degree assault, a felony, third-degree criminal mischief, a felony, disorderly conduct and harassment.
