New City Resident, 18, Charged With Faking Documents To Avoid Court-Ordered Community Service

An 18-year-old New City resident who found himself in trouble in Haverstraw Town Court in 2010 over a motor vehicle incident is in even more trouble today after he faked documents to claim he had completed 25 hours of court-ordered community service, according to .
Dominick Iervasi of 118 Phillips Hill Road is now accused of two courts of first-degree offering a false instrument for filing, a felony. Iervasi was arraigned by Haverstraw Town Judge John Grant and released on $1,000 bail pending a hearing on Friday.
On April 10, 2010, Iervasi was charged with third-degree aggravated unlicensed operation of a motor vehicle, a misdemeanor, for a motor vehicle incident in Haverstraw. As part of a favorable disposition by a judge in the case, Zugibe said Iervasi the was ordered to complete 25 hours of community service with a local nonprofit organization.

Iervasi was then required to provide proof to the court that he successfully completed the community service.
“The defendant in this case is accused of taking advantage of the system,” Zugibe said. “While the judge believed he was helping to rehabilitate this offender, it became apparent that he was actually committing a fraud upon the courts."

Iervasi was arrested after an investigation by the Rockland County Special Investigations Unit of the District Attorney’s Office. Zugibe said his office has found an increase in the number of incidents of offenders trying to scam the courts and avoiding community service.
“We have seen a disturbing rise in the number of individuals attempting to con the criminal justice system through fraudulent documentation,” Zugibe said. “Any defendant found not to be living up to their end of the bargain will be marked for arrest and prosecution.”
On Sept. 26, 2011, and Oct. 31, 2011, Iervasi is accused of filing fraudulent letters with the Haverstraw Town Court, including one purported to be authored by an administrator at Northern Manor Multicare Center in Nanuet.
Zugibe said both letters were authored by Iervasi, falsely stating that he had fulfilled the sentencing requirements. He also said Iervasi is charged with putting an official Northern Manor stamp to one of the letters without permission or authority to do so.
