RETIRED SURROGATE HON. EDWARD W. McCARTY, III JOINS VISHNICK McGOVERN MILIZIO LLP

Hon. Edward W. McCarty, III, the Nassau County Surrogate from 2011 until his retirement in 2016, joined Vishnick McGovern Milizio LLP, headquartered in Lake Success, NY in April 2016 as Of Counsel in the Trust and Estate Administration and Litigation practice groups, as well as the Alternate Dispute Resolution practice group.
VMM Managing Partner Joseph G. Milizio states, “It is a great honor to our firm that Judge McCarty brings his legal acumen, spirit of public service and diverse background – from the military to the district attorney’s office to the bench to law school professorships – as he segues into the latest phase of his career.”
Hon. McCarty is also currently is a mediator-arbitrator in National Arbitration and Mediation (NAM), where he specializes in medical malpractice, trusts and estates, international law, clergy abuse, commercial law and orphan art redemptions.

When asked about making this transition, Judge McCarty commented, “Leaving the bench after 30 years was a difficult task, since I had accomplished a lot of good in numerous peoples’ lives. I knew I would miss the opportunity to help people during difficult challenges for themselves and their families. I accepted a position at Vishnick McGovern Milizio with the knowledge of the firm’s approach to helping people, gained by my observations as a judge and the personalities of the members of the firm.”

A resident of Bellerose Terrace in Nassau County, Hon. McCarty was elected Justice of the New York State Supreme Court from 1992 until 2010, where he presided over medical malpractice and other matters litigated in the courts. From 1985 until 1991, Judge McCarty served in the District Court of Nassau County. His civilian legal career also included Nassau County Assistant District Attorney in the Homicide Bureau from 1972 until 1985, and prosecutor for the Judicial Inquiry of Professional Conduct from 1971 to 1972.
A retired US Army Colonel in the Judge Advocate General’s Corps, Judge McCarty received the Legion of Merit and a Bronze Star for his service during Operation Desert Storm. He has had many international and national legal experiences, including assistant mission director for the Department of Defense in providing humanitarian support to Afghan refugees in Pakistan in 1990. He also has provided legal restoration services in the Balkans, Eastern Europe and Haiti, and is a contributor to the American Bar Association’s Central Eastern European Legal Initiative. In 2005, Judge McCarty spent a month providing hurricane relief in Louisiana following Hurricanes Katrina and Rita. He was a judicial participant in 2008 in the Sir Richard May International Law Seminar at The Hague in the Netherlands; Cassin Seminar on Human Rights Law in France in 2009; and Massachusetts Institute of Technology – DNA evidence in 2011.
Hon. McCarty received a Bachelor of Science degree, with a major in Economics and minor in English, from Siena College, where he was a student senator, an executive board member of the student government and a varsity lacrosse player. He received his Juris Doctor degree from St. John’s University School of Law. Judge McCarty also earned a diploma from the Foreign Service Institute; a certificate in forensic medicine from the NYU School of Medicine; and a diploma from the U.S. Army War College. Since 2004, he has been a special professor at the Maurice A. Deane School of Law at Hofstra University, where he teaches estate planning. Also at Hofstra Law, Judge McCarty is a faculty member teaching trial techniques, which he also covers at the Widener University School of Law. Additionally, he teaches estate planning and medical malpractice courses at this alma mater, St. John’s University School of Law, where he has been an adjunct professor since 2011.
