Finne is believed to have been in the eastbound shoulder of the roadway, police said. Finne was transported to Eastern Long Island Hospital and then moved to Stony Brook University Hospital before he passed away, police said. Fitzpatrick was uninjured in the collision, police said.
No criminal charges are expected, but the case is still under investigation by police detectives, police said.
But his family and friends are left devastated by his loss.
Craig Finne said his brother loved his family, taking walks in the woods, and fishing.
"Anything to get the family together," he said. "Me, being the little brother, he always made sure I was okay and had a roof over my head."
He added that his brother "was always happy, no matter what. His kids were his life."
Finne, his brother said, left behind two sons, Christopher and Dylan, his future wife Laura, brothers Harry and Craig and Craig's wife Kathy, sisters Leigh and Regina Finne, his mother Marie Pilles and father, Harry Finne, Sr., his stepmom Karen Finne, as well as many nieces and nephews and his ex-wife Lisa Tabor Finne and numerous friends.
"He was surrounded by loved ones as he passed," Craig said. "He will definitely be missed."
