
, one of Nyack's newest eateries, may miss out on major revenue this holiday season.
The two-month-old, family-owned restaurant just one block from the Hudson River is hoping to lock down a temporary liquor license for the winter months, but a State Liquor Authority (SLA) rule isn't allowing it.
The "500 Foot Rule" prevents establishments seeking a temporary liquor license, like Baumgart's, from obtaining one if they are located within 500 feet of three or more other businesses with licenses.

Baumgart's applied for the temporary license about one month ago, and planned on securing a permanent license soon after. But the SLA mailed a letter denying the initial request.
Irene Wu, the restaurant's manager whose family owns the eatery, said Baumgart's customers would be having their drinks with lunch and dinner.

"Some people may just want to enjoy a glass of wine with their meal," she said. Wu added that the restaurant is talking with lawyers in hopes of finding a workaround.
Officials with the SLA explained that the 500 Foot Rule only applies to temporary licenses, and that Baumgart's will probably be granted a permanent license—but not before the holidays.
"It is quite likely they will get the [permanent] license," said Bill Crowley, a representative with the SLA. "Sometimes we'll get opposition to these, but we haven't yet."
Crowley added Baumgart's application for a permanent license is pending, and will likely pass in three months.
Some Nyack officials, who are simultaneously combating on Main Street, are fighting on behalf of Baumgart's.
"It's going to have a tremendous effect on their business," said trustee and mayor-elect Jen Laird-White.
Residents have been vocal, too.
"The whole community has been really supportive," Wu said. "It really has been nice to hear from customers that [this is] ridiculous."
