Felony DWI Charge for Cortlandt Man with Baby Son in Car

His blood alcohol content was .08 percent, police allege.

New York State Police arrested Javier J. Erraez-Patino, 33, for Aggravated Driving While Intoxicated under Leandra’s Law, a Class E Felony.

Police allege that subsequent to a lawful vehicle and traffic stop conducted on East Main Street in Cortlandt Aug. 22, Erraez-Patino was found to be intoxicated.

The Cortlandt resident was charged with Aggravated DWI under Leandra’s Law due to the fact that his 1-year-old son was in the vehicle at the time of the stop.

Erraez-Patino provided a positive breath sample that yielded a Blood Alcohol Content of .08 percent.

He was arraigned at the Town of Yorktown Court and remanded to Westchester County Jail on $1,000 bail and was due to appear in the Town of Cortlandt Court on Aug. 24, police said.
