Leandra's Law Invoked for DWI Charge
Police stopped a man at 2:30AM in Peekskill. His wife and two children were in the car.

State police stopped a car they had clocked doing 48 mph in a 30 mph zone in Peekskill at 2:30 a.m. Dec. 13. A husband and wife and their two children, aged 2 and 13, were in the car.
The trooper saw signs that the driver, Juan Chavez Garcia, 33, was intoxicated. They took him to the Cortlandt state police station where he took a breathalyzer test. His BAC was .08 percent—the legal threshold for driving while intoxicated.
The Peekskill resident was charged with felony DWI because he has a previous conviction for drunk-driving; charged with violating Leandra’s Law, for having a child passenger under the age of 16; and given a speeding ticket.
