State police said members assigned to SP New Rochelle arrested Fredy A. Regalado-Carranza, 32, of Port Chester, for aggravated DWI with a passenger less than 16 under Leandra's Law.

At about 1:28 a.m. , troopers saw a 2012 Mazda sedan traveling southbound on South Main Street in the village of Port Chester with children unrestrained in the back seat, according to state police. Troopers stopped the car and, during an interview with the driver, identified as Regalado-Carranza, showed signs of intoxication, state police reported.

Standard field sobriety tests were administered and indicated impairment, according to state police. Police said five children were in the vehicle, ranging in age from 15 years to 2 months.

Regalado-Carranza was taken into custody and transported to SP New Rochelle, where he registered a blood alcohol concentration of 0.15 percent, according to state police. In addition to the aggravated DWI charges, he was also charged with traffic violations, state police said.

Leandra's Law is the name used by police for aggravated DWI charges involving a passenger younger than 16. In this case, state police said there were five children in the vehicle, which is reflected in the five counts filed against Regalado-Carranza.

State police said Regalado-Carranza was released to a sober third party. He is due in Rye Town Court on Nov. 20.

The children were also turned over to a sober third party, according to state police.
